LEGAL FEES

Our approach to legal fees is driven by our goal of providing top-notch and cost-effective legal services.

We offer our clients the option to choose from different fee models, including flat fees, hourly rate fees, and hybrid billing. In appropriate cases, we will also enter into contingency fee arrangements. We explain each of these options below.

Flat Fees

Under a flat fee model, we charge you a fixed fee for our legal services. For litigation matters, we break the fee down and charge fractional flat fees for each stage of litigation. The main benefit of this model is that you know at the outset exactly how much you will pay in legal fees.

Hourly Rate

This is the traditional billing model for lawyers. Under this structure, we charge an hourly rate for our time and charge you for the time that we spend on your behalf. Rikin Morzaria's current rate is $400 per hour. The benefit of this model is that you only pay for the time we actually spend on your case. The downside is the unpredictability of hourly fees. We do what we can to reduce this uncertainty by giving estimates of fees as matters progress. If matters evolve and become more complex, we will let you know of the developments and how we think they will affect your legal fees. We want you to feel free to communicate as often as is necessary to best advance your case – without worrying about additional fees. As a result, we will not charge you fees for brief calls or messages (about 5 minutes or less) to address general questions about the status of your matter.

Contingency Fees

For certain matters, typically those involving insurance claims, we offer a contingency fee agreement. Our contingency fee agreement means that you will only pay legal fees if we are successful in obtaining recovery for you. Our typical contingency fee is between 20% and 30% of the settlement or judgment (including costs), plus HST. The maximum contingency fee we will charge is 35%.

Hybrid Fee Arrangements

In some cases, the optimal fee arrangement is a mix of two or more of the fee structures.
